Zoning and 180 Day Rule.



Paddlewheel Villas is the first project to be constructed in the City of Vernon's newly created "Waterfront Development Area" This unique and new zone extends from Vernon Creek, along Lakeshore Drive and then south to Paddlewheel Villas. This basically tourist commercial zone was designed to allow more public participation and enjoyment in the one of the Okanagans scarcest resources, waterfront property.

Although Paddlewheel Villas is residential, residential/resort in appearance and function the zone is basically tourist commercial to both encourage and allow short and long-term rental accommodation. The instrument the city has used to achieve their goals is a restrictive covenant registered against title, which restricts a single owners usage to 180 days per year. The actual wording is - a Strata Lot shall not be used by the Owner for Personal Use more than the Maximum Number of Calendar days per year. That maximum is 180 days per year. The covenant also clarifies an owner as "Owner" means the owners of the Strata Lots as registered on title to such lots at the Kamloops Land Title Office from time to time, and includes the directors and officers of any corporate owner and their spouses; For the purposes of clarification, each person or entity that constitutes an "Owner" of a fractional or registered interest in less than an entire interest in a lot shall be considered a separate "Owner" for the purposes of the calculation set out in Paragraph 2 hereof; and defines personal use as "Personal Use" means that use of a Strata Lot as a place to stay by the Owner.
